Booking Terms and Conditions The Property 1. The gîtes known as Kerbihan & Kermeur ("the Property") are offered for holiday rental, subject to confirmation by Mr & Mrs N. Dent ("the Owner") to the renter ("the Client" also referred to as “The Party Leader”). Reservations 2. To reserve either Property, the Party Leader should complete and sign the booking form and return it to the Owner while at
the same time making arrangements to credit the Owner’s bank account (details given on the booking form) with payment of the initial non-refundable deposit (25% of the total rental due). The Owners will accept booking forms sent via e-mail. Following receipt of the booking form and confirmation of payment, the Owner will send a booking confirmation and receipt. This is the formal acceptance of the booking. NB Clients are advised to confirm availability of the Property with the Owner prior to making a reservation. Payments Due 3. An initial non-refundable deposit payment of 25% of the total rental, is payable into the Owner’s bank account at the time of making the initial booking (details given on the booking form). 4. The balance of the rent, together with the £150 breakage/security deposit (see clause 6) is payable into the Owner’s bank account not less than 6 weeks before the start of the rental period. If payment is not received by the due date, the Owner reserves the right to give notice in writing that the reservation is cancelled. The Client will remain liable to pay the balance of the rent unless the Owner is able to re- let the Property. In this event, clause 7 of the booking conditions will apply. 5. Reservations made within six weeks of the start of the rental period require full payment into the Owner’s bank account at time of booking. Breakage/Security Deposit 6. A Breakage/Security deposit is applied at a rate of £150 per gîte. The Breakage/Security deposit is required in case
of, for example, damage to the property or its contents. However, the sum reserved by this clause shall not limit the Client's liability to the Owner. The Owner will account to the Client for the breakage/security deposit and refund the balance due, within one week after the end of the rental period, by means of payment into the Client’s bank account, details of which the Client will provide to the Owner. 7. In the event of a Client renting both properties, then the deposit of £300 will be treated as a single Breakage/Security Deposit. Cancellation 8. Subject to clauses 3 and 4 above, in the event of a cancellation, refunds of amounts paid, will be made if the Owner is able to
re-let the Property and any expenses or losses incurred in so doing will be deducted from the refundable amount. NB The Client is strongly recommended to arrange a comprehensive travel insurance policy (including cancellation cover) and to have full cover for the party's personal belongings, public liability etc. since these are not covered on the Owner’s insurance. Rental Period 9. Rental periods will normally consist of one or more whole weeks but during July and August the Owner reserves the right to fix minimum rental periods at two weeks. 10. The rental period shall commence at 4pm on the first Saturday and finish at 10am on the last Saturday of the rental period.
The Owner shall not be obliged to offer accommodation before the time stated and the Client shall not be entitled to remain in occupation after the time stated. NB The Client is requested to advise the Owner if arrival time is likely to be after 10pm. Residents 11. The maximum number to reside in the Property must not exceed 6 people + 1 baby for Kerbihan and 8 people + 1 baby for
Kermeur, unless the Owner has given prior permission. 12. Sorry, the Owners are unable to accept pets and would ask you to recognise that the gîtes are Non-Smoking. 13. If the Owners offer the Client a special rental price based on under occupancy, then the Clients are required to obtain the Owners permission to exceed that agreed occupancy. Responsibilities of the Client 14. The Client agrees to be a considerate tenant and to take good care of the Property, all furniture, appliances and other items
supplied with it and to leave the Property and said items in a clean and tidy condition at the end of the rental period. (The Owner offers an optional end of stay cleaning service, which can be booked in advance, see clause 15). The Owner reserves the right to make an additional retention from the breakage/security deposit to cover additional cleaning costs if the Client leaves the Property in an unacceptable condition. 15. The Client agrees not to act in any way, which would cause disturbance to those residents in neighbouring properties or other residents of Da Kanaouenn. 16. The Client shall report to the Owner without delay, any defects in the Property or breakdown in the equipment, plant, machinery
or appliances in the Property, and arrangements for repair and/or replacement will be made as soon as possible. Optional End of Stay Cleaning Service 17. The Owner provides an optional Cleaning Service at the end of the rental period for a cost of £30. This should be requested at the time of making a reservation, by including it in the appropriate place on the booking form and added to the payment terms for the holiday. 18. If the Client chooses not to pre-book the End of Stay Cleaning Service, this can still be requested during the rental period at a charge of 50 Euros, due in cash by the last Thursday of the rental period, subject to agreement with the Owner. 19. The Cleaning Service does not cover items such as crockery, cutlery, pots and pans, BBQ or the wood burning stove etc, which remains the responsibility of the Client during the duration of the rental period. Services and Equipment 20. In the months from April to October the rental price includes all normal usage of gas, water and electricity. At other times of the year, the rental price will include an allowance for electricity. An initial quantity of logs will be provided, for use in the wood burning fires, additional wood may be purchased from the Owner. 21. In the Property, pillows, duvets and all bed linen are provided and included in the rental price. Beds will be made up prior to arrival and for Clients renting for more than one week, clean bed linen will be exchanged on the middle Saturdays. 22. Tea towels and oven gloves will be provided. NB Clients should note that no towels are provided. 23. Cots and High Chairs are available on request at the time of booking.. The cot is atravel cot and the manufacturers recommend, but the Owners do not warrant, that it is suitable “from birth to approx. 24 months or when your toddler starts to climb out (approx. 14kg).” NB Clients should note that Cot linen is not provided for hygiene reasons. Owner’s Responsibilities 24. The Owner shall not be liable to the Client:
For any temporary defects or stoppage in the supply of public services to the Property, nor in respect of any equipment, plant,
machinery or appliances in the Property, or garden. For any loss, damage or injury, which is the result of adverse weather conditions, riot, war, strikes or other matters beyond the control of the Owner. For any loss, damage or inconvenience caused to or suffered by the Client if the Property shall be destroyed or substantially damaged before the start of the rental period and in any such event, the Owner shall within seven days of the notification to the Client, refund to the Client all sums previously paid in respect of the rental period. 25. Under no circumstance shall the Owner's liability to the Client exceed the amount paid to the owner for the rental period.
26. The Owner shall not accept any responsibility for vehicles brought onto the property. 27. This contract shall be governed by English Law in every particular, including formation and interpretation and shall be deemed to have been made in England. Any proceedings arising out of or in connection with this contract may be brought in any court of competent jurisdiction in England. |
